steezr cloud terms of service

These terms are the contract between you and steezr s.r.o. for using steezr cloud. You accept them when you create an account. Please read sections 3, 6 and 8 in particular: they say what we do and don't run, what you can't use the service for, and when we can switch your access off.

1. Who we are and what these terms cover

1.1 steezr cloud ("the service") is the website steezr.cloud, the dash web app at dash.steezr.cloud and its API, the scloud command line tool, the steezr cloud iOS app, the steezr cloud GitHub App, and the software dash installs on your clusters to manage them.

1.2 The contract is concluded when you create an account and confirm that you accept these terms. If you create or join an organization in dash on behalf of a company, you confirm you're allowed to bind it, and the company is bound by these terms too. "You" means you and that company.

1.3 The privacy policy explains how we handle personal data about you. Where we process personal data on your behalf, the steezr Data Processing Terms apply automatically and form part of this contract.

2. For businesses only

2.1 The service is for people acting in the course of their business or profession, as entrepreneurs under Section 420 of the Czech Civil Code. Freelancers and developers working on their own projects for business count. We don't contract with consumers.

2.2 By creating an account you confirm you're using the service for your business or profession and that you're at least 18 years old. Consumer protection law therefore doesn't apply to this contract.

3. What steezr cloud is, and what it isn't

3.1 steezr cloud is a control plane. It sets up and manages Kubernetes clusters, deploys apps to them and shows you what's running. We don't host your apps or your data.

3.2 Your clusters run on servers in your own Hetzner Cloud project, under your own contract with Hetzner Online GmbH. Hetzner hosts everything that runs on them: your apps, databases, buckets, logs and backups. Hetzner bills you directly for what you use, including servers, volumes and load balancers that dash creates when you ask it to. Hetzner's terms apply to your use of Hetzner.

3.3 What we do run is dash, its API and database, the GitHub App, and the DNS names under steezr.cloud that point to your clusters, together with their TLS certificates.

3.4 When you connect Hetzner or GitHub, you give dash access to your accounts there so it can act on your instructions. You stay responsible for those accounts, their settings and their costs. GitHub's terms apply to your use of GitHub.

4. Your account

4.1 Give us accurate information and keep it up to date. Each account is for one person. Don't share it; invite colleagues to your organization instead.

4.2 Keep your password, two-factor codes, CLI and app tokens, and Hetzner API token safe. Tell us at support@steezr.com straight away if you think someone else got access.

4.3 Owners and admins of an organization decide who joins it and what each member can do. You're responsible for what happens through your account and, as an organization, for what your members do in it.

5. Beta, price and availability

5.1 steezr cloud is in beta and free to use. Features and limits can change, and some may be removed.

5.2 Before we start charging for anything, we'll publish the prices and tell you by email at least 30 days ahead. Nothing becomes paid for you unless you agree to it.

5.3 We take professional care to keep the service available and secure, but we don't guarantee uninterrupted availability and there is no service level agreement. Your apps keep running on your clusters while dash is unavailable. We aren't responsible for outages at Hetzner, GitHub, Cloudflare, Let's Encrypt or other providers the service relies on.

5.4 dash can back up your databases to storage in your Hetzner project. That doesn't replace your own backups of data that matters to you.

6. Acceptable use

6.1 You must not use the service, or the apps, clusters and steezr.cloud names you manage with it, to:

6.2 You also must not try to get into other customers' organizations or data, get around limits or security measures, overload or disrupt the service, or resell access to dash without our written agreement. If you find a security problem, report it to support@steezr.com and don't access data that isn't yours.

7. Your apps, your responsibility

7.1 You decide what you deploy and you're responsible for it: your code, images, config, data and anything your apps make available to others. That includes complying with the law that applies to your business, such as data protection, consumer and copyright law. We don't give legal advice.

7.2 We don't monitor what runs on your clusters and have no general duty to. If we learn that something breaks section 6, we act under section 8.

7.3 If someone claims against us because of your apps or content, or because you broke section 6, you'll compensate us for the resulting harm, including reasonable legal costs.

8. When we can suspend or close your account

8.1 We don't support illegal activity, and we won't let the service be used for it. We may act under this section if we have reasonable grounds to believe that:

8.2 Because we don't host your apps, our measures apply to what we control. Depending on how serious the problem is, we may:

8.3 We use the mildest measure that solves the problem, and we act without warning only when waiting would cause harm or the law requires it. We'll tell you what we did and why, unless the law or an authority stops us or telling you would help someone cover up a crime. You can reply to support@steezr.com and we'll review our decision. Once the cause is fixed, we lift a suspension.

8.4 For serious breaches, such as abuse material, terrorist content, malware, phishing or repeated breaches after a warning, we may close the account or organization immediately and end the contract.

8.5 We don't delete servers or data in your Hetzner project. What happens to them there is between you and Hetzner, which may take its own measures under its terms.

8.6 We aren't liable for harm caused by a suspension or closure that we carried out in good faith under this section.

9. Reporting illegal content

9.1 Anyone can report illegal content or abuse connected to steezr cloud to support@steezr.com. Tell us the exact address (URL or steezr.cloud name), why you think it's illegal, and how to reach you. You can write in Czech or English.

9.2 We review reports promptly and act under section 8. Because the content is hosted on servers in our customer's Hetzner project, we may also forward the report to Hetzner. We'll let you know what we did.

9.3 The same address is our point of contact for authorities, the European Commission and the European Board for Digital Services under Articles 11 and 12 of Regulation (EU) 2022/2065 (Digital Services Act).

10. Ending the contract

10.1 You can end the contract at any time by deleting your account: in dash under Account → Delete account, or in the iOS app under Settings → Delete account. The support page explains what happens to organizations you own.

10.2 We can end the contract with 30 days' notice by email, for example when the beta ends or if we stop offering the service. We can end it immediately under section 8.4.

10.3 When the contract ends, your clusters and the data on them stay in your Hetzner project and keep running, but dash no longer manages them and the steezr.cloud names may stop working. Move your apps to your own domains before then. The privacy policy says how long we keep data about you afterwards.

11. Intellectual property

11.1 Your code, images, data and content stay yours. You allow us to process them only as far as we need to run the service for you.

11.2 The service, including dash, the CLI, the iOS app, the agent and our charts, belongs to steezr s.r.o. or its licensors. While the contract lasts, you may use it for your own business, without the right to sublicense or transfer it. Open source components are governed by their own licences.

11.3 If you send us ideas or feedback, we may use them freely.

12. Liability

12.1 Our total liability for damage under this contract is limited to the amount you paid us for the service in the 12 months before the damage occurred. While the service is free, that amount is zero.

12.2 We aren't liable for lost profit, lost data, lost business opportunities, damage to reputation, or indirect or consequential damage. We also aren't liable for your Hetzner, GitHub or other provider costs.

12.3 These limits don't apply where the law doesn't allow them, in particular for damage we cause intentionally or through gross negligence.

13. Confidentiality

We keep your non-public information confidential, in particular your source code, config values, access tokens and business data. We disclose it only to people who need it to run the service and are bound to keep it confidential, or where the law or an authority requires it. This duty lasts during the contract and for 3 years after it ends.

14. Changes to these terms

We may change these terms, for example when we add features, start charging or the law changes. We'll publish the new version here and tell account holders by email at least 30 days before it takes effect. If you don't agree, you can delete your account before then. If you keep using the service after that date, the new version applies to you.

15. Final provisions

15.1 This contract is governed by Czech law, in particular the Civil Code (Act No. 89/2012 Coll.). Disputes go to the Czech court with local jurisdiction according to our registered seat.

15.2 The steezr Terms and Conditions govern professional services you order from us separately under a quote, such as setup, migration or development work. They don't apply to your use of the service itself.

15.3 If a provision of these terms is invalid, the rest stays in force, and we replace it with a valid one that comes as close as possible to its purpose.
